This website https://kiraaruto.myshopify.com is published by Kira ARUTO SAS, a simplified joint-stock company (SAS).

These terms govern the distance selling relationship between Kira ARUTO SAS and any user or customer, in accordance with applicable French and European law, in particular:

  • Law No. 2004-575 of 21 June 2004 on Confidence in the Digital Economy (LCEN);

  • The French Consumer Code;

  • The French Commercial Code;

  • Regulation (EU) 2016/679 (GDPR);

  • Law No. 78-17 of 6 January 1978 as amended relating to data processing, files and freedoms.

Kira ARUTO SAS reserves the right to modify these terms at any time without prior notice. The applicable terms are those in force on the date of the order.

The purpose of the website is the online sale of clothing and accessories.

The duration of the contract is limited to the supply of the ordered products, without prejudice to the right of withdrawal.

By placing an order, the customer declares that they:

  • have read and accepted these terms;

  • are at least 18 years old;

  • have the legal capacity required to enter into a contract.

3. WEBSITE ACCESS AND CUSTOMER ACCOUNT

Users may create a customer account in order to place orders. Login credentials are strictly personal and confidential.

The customer is responsible for maintaining the confidentiality of their login details and for all activities carried out through their account.

Account information may be modified at any time via the customer area. Order history is available for information purposes only.

4. PERSONAL DATA

The personal data collected is necessary for order management and the commercial relationship.

Legal bases for processing:

  • performance of the contract;

  • customer consent;

  • legal obligations.

Data is retained only for as long as necessary for the purposes for which it is processed, unless a longer retention period is required by law.

In accordance with applicable regulations, the customer has the following rights:

5. ORDER CONFIRMATION

Once the order has been validated, a confirmation email is sent to the customer.

If no confirmation is received within 24 hours, the customer is invited to contact: contact@kiraaruto.com

Each order is accompanied by an electronic invoice or an order summary.

6. OFFERS AND AVAILABILITY

Offers are valid as long as they are displayed on the website, subject to product availability.

Kira ARUTO SAS reserves the right to cancel any order in the event of an obvious pricing or description error.

7. PRICES

Prices are indicated in euros (€), inclusive of all taxes (VAT included).

Any specific taxes applicable depending on the delivery destination will be indicated before order validation.

8. PAYMENT METHODS

Payments are secured via certified service providers (Stripe, Shopify Payments, PayPal, or other solutions offered on the website).

Banking data is never stored by Kira ARUTO SAS.

9. DELIVERY

Kira ARUTO SAS delivers worldwide, subject to local restrictions.

Delivery costs and estimated delivery times are displayed before order confirmation.

Customs duties or local taxes may apply outside the European Union and remain the responsibility of the customer.

10. RIGHT OF WITHDRAWAL AND RETURNS

The customer has a 14-day calendar period from receipt of the product to exercise the right of withdrawal.

Return shipping costs are borne by the customer.

Refunds will be issued using the original payment method within a maximum of 14 days after receipt of the returned items.

11. DEFECTIVE PRODUCTS

In the event of a defective or non-conforming product, the customer must contact customer service at contact@kiraaruto.com.

Return and reshipment costs will be covered by Kira ARUTO SAS.

12. DISPUTE RESOLUTION

In accordance with Article 14 of Regulation (EU) No. 524/2013, the European Commission provides an online dispute resolution platform:

13. APPLICABLE LAW AND JURISDICTION

These legal notices are governed by French law.

In the event of a dispute, the French courts shall have exclusive jurisdiction, subject to mandatory consumer protection provisions.

14. SMS MARKETING

By agreeing to receive SMS communications from Kira ARUTO SAS, the customer consents to receiving transactional and marketing notifications.

Consent is not a condition of purchase.

The customer may unsubscribe at any time via the unsubscribe link included in each message.

Data related to SMS marketing is used solely for this purpose and is never sold to third parties.
